Version 1.01
1.1 This website is operated by Bolota, an individual company with legal name BOLOTA di Gonçalves De Oliveira, postal address at Via Calprino 5, CH-6900 Paradiso, registered with commercial number IDI CHE-481.284.292 and sited in Switzerland, Canton Ticino. The General Terms and Conditions (hereinafter referred to as GTC) define the entire contractual conditions between Bolota (hereinafter referred to as “Bolota”, “we”, “us”, “ourselves”, “our”, “the company”) and every person acceding this website (hereinafter referred as “you”, “customer”).
1.2 All physical correspondence must be addressed to our legal address (Via Calprino 5, CH-6900 Paradiso) and the digital correspondence to our institutional e-mail address (info@bolota.ch).
2.1 Our offers are aimed to adults (or legally entitled as so) resident in the Swiss territory. All the offers are Bolota’s best effort, being however non-binding. The offer can change without any previous advise.
2.2 The customer receives a confirmation of receipt of the order without any binding effect. In particular, Bolota reserves the right to not accept an order if the quantities ordered exceed normal household consumption or in case of a system error. An order is placed only on confirmation of shipment. Any order can be cancelled before the expedition.
3.1 Orders are accepted via the www.bolota.ch website (and its sub-domains) or direct contact with the company. If an item is not available after confirmation of receipt of the order, the corresponding order will be cancelled without a cost for the customer. The customer cannot claim further rights.
3.2 The delivery time indicated in the offer or in the confirmation of receipt of the order is only indicative and it is not binding. If Bolota cannot comply with a delivery deadline, the customer can withdraw from the order 30 days after the confirmation of receipt of the order with written notice.
3.3 Bolota is authorized to make partial deliveries in case it is not possible to deliver all products ordered at once, that is no right to cancel the entire order. The customer cannot claim further rights. The customer won’t pay more if that happened by Bolota initiative. If it is a special request from the customer, it can be charged a complementary fee.
3.4 Delivery is made exclusively to addresses in Switzerland, at the expense and risk of the customer. The ordered goods are delivered only on the customer’s address or post office box. When ordering, the customer is given the option to choose a transport guarantee, for a fee, which covers the value of the goods ordered in case of transport damage. The customer is responsible for the address exactitude.
3.5 If a withdrawal period is indicated, the customer must pick up the ordered goods. If the goods are not collected within the specified period, Bolota has the right to cancel the contract and charge the customer with an expense contribution.
3.6 The customer undertakes to immediately check that the goods received or withdrawn are correct, complete and intact. Any damage to the goods received or withdrawn must be communicated to Bolota and to the transport company as soon as possible, at the latest within three (3) calendar days of delivery. In the event of a claim, the customer must keep all parts of the original packaging. The customer can only destroy these parts with the written consent of the transport company or Bolota.
4.1 Bolota is authorized to change the price at any time. The price published at the time of ordering applies to the contract. Price changes after confirmation are not considered.
4.2 All Bolota’s prices are inclusive of value added tax (VAT) in Swiss francs (CHF). Auxiliary costs (eg. shipping costs, special packaging, surcharges for certain means of payment, transport guarantee, assistance, etc.) are not included in the price and are indicated in the checkout and counted separately. Any technical changes, mistakes and printing errors remain always reserved.
5.1 The payment methods accepted are listed on the website. Bolota can exclude certain payment methods in general or for individual customers without specifying the reason. Bolota has the right to apply surcharges for the use of certain individual means of payment.
5.2 The purchase with debit or credit cards is charged at the time of ordering. The data of the payment by debit or credit card are transmitted in encrypted form by certified providers (SIX Payment Services and Post Finance Payment Services), fulfilling the best technology practices at the moment. In the case of a prepaid purchase, the order is initiated only after receipt of payment by Bolota. In the event of poor availability of goods, it may happen that goods with status in stock are no longer immediately available at the time the order is placed. Bolota can cancel the order if it does not receive the payment within five (5) calendar days.
5.3 The products delivered by Bolota or collected by the customer remain the property of Bolota until payment of the full purchase amount (including all surcharges and fees) is full received. The customer undertakes to use the products with care if they are owned by Bolota.
5.4 Our payment service provider (PSP) is Post Finance (Post Finance SA, Mingerstrasse 12, CH-3030 Bern, www.postfinance.ch) and our credit cards acceptance is controlled by SIX Payment Services
6.1 Right of return and replacement
For some products and in accordance with the withdrawal deadline, the replacement can be considered. The replacement occurs if the product is sent by mistake, is not in accordance with the description in the web site or is faulty. The invoice note is valid as a guarantee certificate and should be carefully preserved. The withdrawal must be requested and is only possible within two weeks (14 days) after receipt of the goods. The date of the postmark is authentic. The goods must be returned in its original packaging, complete with all the accessories and with the invoice note/guarantee certificate. Postal costs for returns or exchanges are the customer’s responsibility and will be reimbursed by us only in the case of faulty or incorrectly supplied goods.
6.2 Procedure in case of faulty products
It is considered a faulty product a product that is not functional, is damaged or incomplete in part or whole, resulting from a bad conception, misdescription or damaging. If the defect is detected on delivery, the customer must contact Bolota immediately and report it. The return must always be previously agreed with Bolota, otherwise, it may be charged to the costumer. Any damage occurred during the transport is not suitable of justify a faulty product.
7.1 Claims for damages due to the impossibility of carrying out the service, breach of contract and unlawful action are excluded, except in cases of fraudulent behaviour or gross negligence. Liability for indirect damages and consequential damages deriving from use, for incorrect performance or non-performance is excluded.
8.1 Data Protection Statement
All visits to the Internet page bolota.ch, bolota.it, bolota.fr and bolota.de, and its sub-domains, are subject to the data protection (GDPR). Bolota uses cookies to ensure the best experience on the website and inform the users about it in the website, via pop-up. Bolota website site is encrypted with a certified Secure Socket Layer (SSL) protocol.
8.2 Individual customer account and purchase as a guest
Some orders, services or products may need an account registration. In order to do that, it is required an username (valid e-mail), the name and surname and a phone number. In addition, a password is defined by the user. The products in the shopping cart are stored independently of an order. In the customer account it is possible to consult the personal data and the acquisition historic (name and address, cart status, purchase data, invoices and downloads, if applicable) is private and will not be shared. That information is always accessible from user account and, by user request, can be permanently cancelled from our server. The customer account data is protected against unauthorized access with the best practices and care imputable to Bolota.
8.3 Advertising and newsletter
The data collected can be evaluated and used for marketing and advertising purposes. Through targeted evaluations, Bolota defines target groups that allow customers to be specifically informed about promotions and other benefits. However, the customer will have the right to opt out of the advertisement at any time by communicating his decision. Each customer can subscribe to an electronic newsletter, which can be cancelled at any time and in all simplicity.
By given their personal data, the costumers agree in receiving newsletter or other advertising material, being always possible to unsubscribe or refuse it in all simplicity.
Bolota do not share personal information with other companies.
8.4 Transmission of data
In order to optimize our offer, Bolota uses mail and Social Marketing services. All the statistics and data collected aren’t personal and can be only used for advertising and marketing purposes. The treatment of all data is in accordance by the GDPR.
8.5 Obligation to retain / delete data
The data are deleted after the end of the contractual relationship or by explicit request.
By consulting our website, or buying from us, you hereby consent and agree to its GTC.
10.1 These GTC can be changed at any time without any previous advise and always prevails the version in the moment you buy or consult the web-site.
10.2 If any omission or unclear information, language misunderstanding or error is detected, only Swiss law applies, which can be consulted in the official web-site.
10.3 The place of jurisdiction is in Paradiso – Switzerland.
All the written or image content in the site or social networks belongs to Bolota, exception the cases that is expressly identified the author.
All the images used in the web-site are Bolota’s propriety – and you are not allowed to use it without our express consent – or belong to on-line stock repositories, which are normally identified in the EXIF information that we never remove.
